City condition notes

The community youth mosaic wall was completed in 3 phases beginning in 2005 and completed in 2009. Children ages 3 to 18 years old created the images which encourage and celebrate living and learning together in a peaceful and diverse community. Tiles and installation labor donated by Syverson Tile and Stone. Tile design manufactured by American Olean Tile Company. SFSD raised the funds to pay American Olean. This piece is not in the annual maintenance program. Background info from PW Real Estate Specialist: May 2015 Based on review of City Real Estate’s records, the land in this area (between 9th Street and 10th Street and along the BSR) currently shown as River Road was not designated as public right-of-way until the attached plat (Book 60 Page 367) defined it in 1999. Prior to that, it appears to have simply been a street on City property. The wall in question appears to be within the public right-of-way, however prior to 1999 it was part of Community Development owned/controlled property. Some background on the wall along the river: In 1932, a Resolution was passed defining the river boundary and the wall was constructed to keep the river within this defined channel. Prior to the construction of the wall, the river meandered farther to the west, actually encumbering most of what is now River Road. I’ve attached the City Resolutions regarding this action, along with a portion of the very large original exhibit from our files. I find nothing indicating the wall as an asset of Drainage/Engineering. I think the case could be made that it is an asset of Community Development, as they owned the land prior to dedicating the public street right-of-way by plat in 1999. We have no record in our office indicating what Department was involved with coordinating the effort to place the mosaic art on the wall within the public right-of-way.
